In consideration of being permitted to volunteer and participate in the Cobble Beach Concours d’Elegance & Motoring Festival (the “Event”), the undersigned (the “Volunteer”) agrees as follows:
1. I understand that my relationship with Cobble Beach Concours d’Elegance Inc. is voluntary and “at will.” I acknowledge that my volunteer role, duties, or participation may be modified or terminated at any time, with or without notice or cause, by either myself or Cobble Beach Concours d’Elegance Inc. I further understand that Cobble Beach Concours d’Elegance Inc. may accept or decline volunteer applications at its sole discretion.
2. I acknowledge that participation in the Event and related activities involves inherent risks that may result in personal injury, illness, death, property damage, or other loss.
3. I freely accept and fully assume all risks associated with participation in the Event and related activities, whether caused by negligence or otherwise, except in cases of gross negligence or intentional misconduct.
4. I release and forever discharge Cobble Beach Concours d’Elegance Inc., Georgian Villas Inc. (o/a Cobble Beach), and their respective owners, directors, officers, employees, volunteers, sponsors, agents, contractors, officials, participants, property owners, and representatives (collectively, the “Released Parties”) from any and all claims, demands, actions, damages, costs, or liabilities arising from or related to my participation in the Event, including claims arising from negligence, breach of duty, breach of contract, mistake, or error in judgment, except in cases of gross negligence or intentional misconduct.
5. I understand and agree that my volunteer service is strictly voluntary and unpaid, and that I will not receive wages, salary, or other monetary compensation for my services.
6. I understand and accept that any information, photographs, video recordings, audio recordings, or other audiovisual content relating to me or captured during the Event may be used by Cobble Beach Concours d’Elegance Inc. and Georgian Villas Inc. for promotional, marketing, archival, commercial, or non-commercial purposes, in edited or altered form, without further notice or compensation. I hereby waive and assign any rights related to the production, reproduction, and publication of such materials.
7. I understand that all Cobble Beach Concours d’Elegance Inc. data, records, files, contact lists, and materials are confidential and proprietary and are intended solely for authorized Event-related purposes. Unauthorized access, use, disclosure, modification, copying, or destruction of confidential information may result in termination of my volunteer position and may lead to further legal action where applicable.
8. I agree to indemnify and hold harmless the Released Parties from any and all claims, damages, liabilities, costs, or expenses, including legal fees on a solicitor-and-client basis, arising from or connected to my negligence, intentional acts, or participation in the Event.
9. I agree that this Waiver and Release shall be governed by the laws of the Province of Ontario and that any legal proceedings relating to this agreement shall be brought exclusively in the courts of Ontario.
10. I confirm that:
• I have had sufficient time to read and understand this Waiver and Release in its entirety;
• I am signing this agreement freely and voluntarily;
• I understand that this Waiver and Release is binding upon my heirs, next of kin, executors, administrators, and legal representatives; and
• I am of the age of majority in the Province of Ontario.
